Terms & Conditions

1. Definitions

“RD Bin Wash Ireland” refers to RD Bin Wash Ireland, a Wheel Bin Cleaning Company, or any of its subsidiaries;
The “Customer” or “You” or “Your”, refers to the individual or entity who accepts these terms and conditions and avails of the Services and/or completes the “Customer Application form” or their duly nominated individuals authorised to act, or receive or send communication on their behalf;

“Customer Application form” means the application for Services completed by or on behalf of the Customer for the services and all information, consents and statements contained therein, which may be given in written form, over the telephone or online;
“Data Protection Legislation” means the Data Protection Act and applicable GDPR legislation in Ireland as amended from time to time;
“Services” means the provision of the Wheel Bin Cleaning Service and any other service provided by RD Bin Wash Ireland to the Customer;
“Wheel Bin Cleaning Service” refers to the regular cleaning process of the Customers’ Bins by RD Bin Wash Ireland;
“Bin”(s) means any wheelie bin supplied by an authorised waste collector to the Customer to which RD Bin Wash Ireland provides its Services;

2. Agreement

This agreement sets out the terms and conditions that apply to your purchase of services from RD Bin Wash Ireland. These terms and conditions form a legally binding agreement (“Agreement”) between RD Bin Wash Ireland and the Customer.
By accepting delivery of Services and/or related products, the Customer agrees to be bound by and accept these conditions. No variation to these terms and conditions shall form part of the Agreement unless the changes have been made in accordance with this agreement.

3. Billing & Payment Terms

3.1
The price of the service provided shall be RD Bin Wash Ireland’s price ruling at the date of the Customer application form or as subsequently advised by the company.

3.2
The Price of Services may vary from time to time. RD Bin Wash Ireland will provide written advance notification (by email or post) to the Customer in advance of any change to service charges. Such notice shall be provided at least 14 days in advance of coming into effect.

3.3
RD Bin Wash Ireland may for operational reasons change its billing method and frequency after prior notification to the Customer. RD Bin Wash Ireland’s preference is to issue bills in a paperless format and may impose an administration charge for the issue of a paper bill.

3.4
RD Bin Wash Ireland may, without notice, suspend service to the Customer wholly or partially if an Invoice is outstanding for 30 days after the invoice date. In the event of overdue payments, the Customer agrees to pay all bin cleans and other costs incurred by RD Bin Wash Ireland in the settlement process.

3.5
If the chosen method of payment is Recurring Payments the Customer must ensure that the Card details provided are from a debit or credit account which can accept Recurring Payments.

In the event of cancellation of a Recurring Payment the Customer shall notify RD Bin Wash Ireland in writing.
It is the responsibility of the Customer to advise RD Bin Wash Ireland in writing of any change to Debit/Credit Card details provided on the original Recurring Payment account.
Customers on recurring payment plans agree to a minimum contract term of 12 months. If a customer breaks the contract before the end of the term, RD Bin Wash Ireland reserves the right to charge the remaining balance due for the minimum contract period.

3.6
Where invoices or other communications are sent by post, they shall ordinarily be sent to the billing address shown on the Customer application form (or any other address notified to RD Bin Wash Ireland) and shall be deemed received by the Customer on the second postal date after the date of posting, and on the same day if sent by email.

3.7
If the chosen method of payment is by an alternative means other than Recurring Payments, the Customer must ensure that their RD Bin Wash Ireland account is maintained in a paid status position to ensure continuation of service.
It is the Customer’s responsibility to ensure that adequate time is allowed for payments to be received by RD Bin Wash Ireland.

3.8
The Customer may change from one billing plan to another with effect from the beginning of any charging period by contacting the company by phone, email or written notice. It is the Customer’s responsibility to ensure RD Bin Wash Ireland has received this notification.

3.9
RD Bin Wash Ireland vehicles may use Bin Identification Technology. This means that cleaning vehicles can identify individual accounts and whether bins should be cleaned.

It is important that Customers keep accounts fully paid and within the payment terms detailed on invoices. Payment must be made a minimum of 3 working days in advance to ensure the account is updated.
If the account is not within agreed payment terms, bins may automatically be rejected for cleaning. Same day payment cannot guarantee service.

3.10
RD Bin Wash Ireland will not accept liability if the bin(s) is moved to a different location without prior notice.

3.11
Where practicable, RD Bin Wash Ireland will make best efforts to keep Customers informed of updates to accounts, reminders of payments due and other service-related matters via electronic methods such as SMS or email.

4. Service Agreement

4.1
This Agreement is personal to the Customer. The Customer shall not, except with RD Bin Wash Ireland’s written consent or in accordance with standard transfer procedures, assign or otherwise transfer the Contract in whole or in part.
Presentation of bins for cleaning service will be deemed acceptance of these Terms and Conditions.

4.2
The term of the Agreement shall be for a minimum period of 12 months from the first billing date or contract commencement date advised by the company, renewable annually.

4.3
RD Bin Wash Ireland may modify or suspend the service wholly or partially, with or without notice, if such action is deemed necessary for operational, health & safety, security or other valid reasons, or if requested by an authorised authority.

4.4
RD Bin Wash Ireland will only service wheelie bins that are left out on the kerbside.

4.5
Bins must be left out on the kerbside the night before the scheduled cleaning day or, if cleaning occurs on the same day as waste collection, bins must be left out after collection for cleaning.

4.6
Late presentation of a wheelie bin will not be serviced until the next scheduled cleaning date.

4.7
All bins must be empty. It is the Customer’s responsibility to ensure that no waste remains in the wheelie bins on scheduled cleaning day.
RD Bin Wash Ireland is not a registered waste collection provider and cannot remove household waste.

4.8
Where service is not carried out on the scheduled day, RD Bin Wash Ireland reserves the right to reschedule the visit to the next reasonable opportunity and no claim shall lie against RD Bin Wash Ireland in this respect.

4.9
Wheelie bins remain the property of the waste collection provider. RD Bin Wash Ireland reserves the right to place identification or promotional stickers on customer bins.

4.10
If notified that an account is on stop, payment must be made at least 3 full working days before the next scheduled cleaning day to ensure service resumes.

4.11
In no event shall RD Bin Wash Ireland be liable to the Customer for damages or losses suffered as a consequence of acts or omissions of third parties.

4.12
Fair usage policies apply at all times. Where, in the opinion of the company, one service is being shared amongst multiple households, RD Bin Wash Ireland reserves the right to suspend services or charge additional fees appropriate to the service being provided.
The company’s decision shall be final.
4.13
Updates to these Terms & Conditions may be communicated via website publication, email or other electronic communication methods and shall be deemed received by the Customer.

5. Termination of Service

5.1
Either RD Bin Wash Ireland or the Customer may terminate this Agreement on expiry of the Term.
If the Agreement is terminated by the Customer before the expiration date for any reason other than RD Bin Wash Ireland’s failure to adhere to these terms and conditions, the Customer remains liable for the remaining monthly charges payable until the end of the Term.
If Services for the Term have been paid in full, no refund shall be payable.
RD Bin Wash Ireland may terminate the service before the expiration date upon provision of at least 14 days notice to the Customer.
Any applicable credit balance may be refunded subject to section 5.5.

5.2
Upon expiry of the Term, unless the Customer provides not less than 30 days written notice by email, letter or phone, this Agreement shall automatically renew on an annual basis under the same Terms and Conditions.

5.3
RD Bin Wash Ireland will only accept cancellation or account changes directly from the Customer and not from unauthorised third parties.

5.4
An account will not be terminated until all monies owed are paid in full.

5.5
Refunds will only be issued upon receipt of written termination notification. Refund requests must be made within 30 days of cancellation notice.

5.6
If a contract is terminated before the minimum contract term of 12 months, an early cancellation fee may apply, including recovery of losses incurred by RD Bin Wash Ireland as a result of the cancellation.

6. Data Protection

RD Bin Wash Ireland collects and processes personal data for legitimate business purposes connected with the delivery of services to the Customer.
RD Bin Wash Ireland agrees to comply with applicable Irish Data Protection and GDPR legislation in connection with the performance of its obligations under this Agreement.

7. Severability

If any provision of this Agreement becomes invalid, illegal or unenforceable, the remaining provisions shall remain fully valid and enforceable.

8. Governing Law

These Terms and Conditions and any claims or disputes arising out of or in connection with them shall be governed by and construed in accordance with Irish law.
Both RD Bin Wash Ireland and the Customer agree to submit to the exclusive jurisdiction of the courts of Ireland in relation to any claim or matter arising under these Terms and Conditions.
